笔者认为，对于上述两类案件应当区分证据认定和实体认定。证据认定证实的是有无泄露内幕信息或者有无利用内幕信息进行交易，求证的核心是“泄露”或者“交易”这两个行为，而实体认定证实的是有关信息本身是否属于内幕信息，求证的核心是信息是否符合内幕信息的特征。前者因为刑事领域和行政领域坚持的证明标准不同，行政执法和刑事司法存在分歧是合理的；后者与证明标准无关，不应因刑事领域、行政领域而有不同的判解，应当保持法律适用的统一，司法机关与行政部门不应存在分歧。如果法院认定不是内幕信息，证监部门认定是内幕信息，可通过检察部门提出抗诉等途径，切不可在案件退回后，直接进行行政处罚。否则，行为人一旦提出行政诉讼，则行政部门和司法机关均会陷入被动。 （文章上半部分见6月8日本报10版。作者单位：最高人民法院刑二庭）
