证券、期货市场是全国性的，证券、期货犯罪不可避免具有犯罪地不明、犯罪地多处、犯罪地交叉等特征，给案件地域管辖的确定带来了困难。此外，证券、期货犯罪案件的主体往往交叉存在国家工作人员，而且还会同时存在贪污、受贿、渎职等犯罪行为，导致职能管辖上的不明和争议。第一种观点建议确立管辖在先原则，由最先发现证券、期货犯罪行为所在地的法院管辖；第二种观点主张，根据《公安机关办理刑事案件程序规定》，涉嫌主罪属于公安机关管辖的，由公安机关为主侦查，人民检察院予以配合；涉嫌主罪属于人民检察院管辖的，由人民检察院为主侦查，公安机关予以配合；第三种观点主张，关于证券、期货犯罪案件的管辖，可借鉴网络赌博案件，本着有利于查清犯罪事实、有利于诉讼的原则，遇到管辖权不明的，可协商解决。经协商无法达成一致的，可由公安部商最高人民法院、最高人民检察院指定管辖。单位犯罪的，由犯罪地管辖。如果被告单位住所地管辖更为适宜，也可由住所地管辖。笔者认为，可以综合第二、三种观点，把握证券期货犯罪案件的管辖原则。
